Participant Agreement and Release
I, the “Releasing Party,” been informed and understand that there is always some unavoidable risk of injury involved when working with animals, either to the animal, the person, or to property. I acknowledge that dogs can be inherently difficult to control and other dogs present at events may not be under control at all times resulting in the possibility of injury to myself, my dog, my family members, or third parties.
In Person Event Participants - I hereby accept and assume, without reservation, all risks, known or unknown, and all responsibility for injury, losses and damages associated with my participation in Sparkly Paw LLC (“Sparkly Paw”) classes or events, including, but not limited to the risks of any and all injuries to myself, my dog and any of my family members who may participate with me and the risk that my dog may cause injury to other persons and/or dogs while at events.
As consideration for participating in Sparkly Paw classes and/or events, I, for myself, my heirs, executors, administrators, legal representatives, successors and assigns hereby forever release, discharge and agree not to sue Sparkley Paw, its directors, agents, officers, volunteers, employees, heirs, succesors, and assigns from any and all liability, claims, demands, losses, including negligence, breach of warranty, breach of contract, and all other causes of action which may arise from my participation in Sparkly Paw training and/or events. I agree to indemnify, defend and hold harmless Sparkly Paw from any and all injuries, losses, claims and damages to any person or persons of any nature whatsoever, including claims arising from Sparkly Paw’s own negligence, and all costs associated therewith, including attorney’s fees, court costs and consultant fees, arising from my participation in Sparkly Paw trainining and/or events.

I agree to abide by any Sparkly Paw rules and regulations. I take it upon myself to ask questions and use my own common sense. I understand that I do not have to participate in any part of a class or event with my dog if I do not feel comfortable doing so. I have read the requirements for the course I am registering for and agree that my dog meets the requirements, including any pre-requisite level of training and health requirements. If my dog becomes injured or ill during a Sparkly Paw course or event, I will stop all activities and training associated with the course or event until my dog has clearance from a vet to resume normal activities. If training a puppy, I will take special care to avoid repetitive moments or any other activities that may harm the long-term health of my dog.​
I hereby agree that any and claims and/or causes of action, including interpretation of this Agreement or otherwise, must be brought in the Superior Court of New Jersey, Monmouth County regardless of where any alleged cause of action arises. Any and all claims are to be governed by New Jersey Law. I further agree that this Agreement shall not be construed for any purpose against the drafter. I hereby agree that I hereby that this Agreement is legally binding and supersedes any other agreement, written or oral, with respect to the terms governed by this Agreement. Should any provision of this Agreement be determined to be unenforceable, the remaining provisions shall remain in full force and effect.
I HAVE READ AND UNDERSTAND THIS AGREEMENT AND RELEASE AND AGREE TO BE BOUND BY THE TERMS AND CONDITIONS HEREIN. I AGREE THAT I HAVE SUFFICIENT INFORMATION AND HAVE BEEN GIVEN SUFFICIENT TIME TO ASSESS THE POTENTIAL DEGREE OF RISKS AND INJURIES. I UNDERSTAND THAT I BY SIGNING THIS AGREEMENT AND RELEASE I AM GIVING UP SUBSTANTIAL RIGHTS AND HAVE SIGNED IT FREELY AND WITHOUT ANY INDUCEMENT OR ASSURANCE OF ANY NATURE. I UNDERSTAND THIS AGREEMENT IS A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY AND I HEREBY AGREE TO SAID RELEASES.
No Guarantee of Results
I recognize that the role I play in my dog’s learning process is integral to achieving desired results. I acknowledge and agree that there is no guarantee that my dog will achieve the desired level of training, despite the best efforts of Sparkly Paw and Jennifer Hollis and I further understand that the recommendation of any other product or service is not a guarantee of satisfaction with that product or service.

Consent to be Recorded
I hereby consent to myself, my dog, any family members or third parties present and my property that appears on camera being the subject of the photographs and/or audiovisual recordings and authorize Sparkly Paw and Jennifer Hollis to cause the same to be exhibited for course material or marketing tools as still photographs, video, or other similar media. I also agree that my name, my dog's name and/or information about my dog including breed, other AKC titles or events I participate in may be shared for course material or marketing purposes.

Refund Policy for Classes
Payments for classes and events are non-refundable, however may be used as a credit in certain circumstances. We suggest you read the information and description carefully before making your purchase. If you have additional questions on the materials to be covered please contact sparklydogpaws@gmail.com PRIOR to purchasing so I may help determine if the topic is suitable for your needs.
All courses must be completed within 12 weeks beginning on the date of their membership is approved for on demand classes or their first zoom meeting for live classes. If the lessons are not completed within this time, it will be at the discretion of Jennifer Hollis to determine if the reason for the delay was warranted. Clients that wish to extend their end training date, must submit a written statement requesting a delay, including the reason for the delay, and the proposed date to resume training prior to the end of the 12 weeks. Clients must receive a written statement, from Jennifer Hollis permitting them to extend their training end date prior to the end of the 12 week period. Without a written statement permitting the extension of the training period or credit for a future training course, the course would be considered forfeited and refunds will not be permitted nor credit issued.

Make up classes are not available for missed live classes; however, those participating in live courses can access all of the on demand materials and will be required to read, watch, learn and practice the material from the missed class prior to the next live class. Class material will often build upon material from previous classes so it is imperative that ​participates take responsibility for reviewing missed material on their own prior to the next live class. Please contact sparklydogpaws@gmail.com to discuss any issues that arise while reviewing missed class material prior to the next live class. Those missing more than one live class may request to extend their training as referenced above and complete all remaining classes in their course through the on demand program or request a credit to join a future live class either from the beginning or from the point they left off. The ability to accommodate a client in a future live course session is on a space available basis and is not guaranteed. If a client who originally signed up and paid for a live course chooses to complete their course through the on demand program due to missed live classes, the difference in the live and on demand course price will not be refunded or credited.
Rescheduling or Cancellations more than 14 days prior to start date: Original payments may be used as a credit to a future class or another service option. However, the ability to accommodate a client in a future live course session is on a space available basis and is not guaranteed.
Rescheduling or Cancellations less than 14 days prior to start date or failure to complete the course within the allotted time as specified above without written approval for extension or credit: Original payment is forfeited; new payment is required to attend a future course or resume a course from where it was abandoned.
